The notices, dated January 16, 2026, pertain to the alleged shortfall in fulfilling the Minimum Production and Dispatch Targets (MDPA Targets) for the fourth year of operations at two mining leases—the BICO and Feegrade Mine.
According to the Demand Notices, an overall amount of Rs 12,55,37,61,591 has been demanded due to the purported shortfall in production and dispatch during the specified period.
The filing indicates that ESL is currently assessing the Demand Notices and associated calculations, asserting that these claims lack merit. ESL intends to pursue appropriate legal remedies, including seeking a stay on the Demand Notices and requesting reliefs, which may involve contesting the validity of the demands.
The production and dispatch targets for both mining leases were determined based on an agreement made with the Odisha government’s mining department. The demand notice has been issued as the company allegedly failed to comply with Sub-Rule 1 of Rule 12 (A) of the Minerals (Other than Atomic and Hydrocarbon Energy Minerals) Concession Rules, 2016 for the fourth operational year of the leases under the Mine Development & Production Agreement dated November 15, 2021.
