Patna, March 6 (NationPress) The tragic demise of a NEET aspirant in Patna has escalated in seriousness following the Bihar government’s revision of its previous notification, now incorporating sections from the Protection of Children from Sexual Offences (POCSO) Act into the case. This modification empowers the Central Bureau of Investigation (CBI) to thoroughly probe the alleged sexual assault aspect related to the incident.
As per official sources, the Home Department’s Police Branch has amended the notification dated January 31, now including Sections 4 and 6 of the POCSO Act, 2012, into the Chitragupta Nagar Police Station Case No. 14/2026.
Moreover, Section 64 of the Bharatiya Nyaya Sanhita and additional pertinent provisions have also been integrated.
This amendment allows the CBI to conduct a legal investigation under these sections and oversee all facets of the inquiry.
When the Patna Police filed an FIR on January 9 at Chitragupta Nagar, the POCSO Act sections were not part of the initial charges.
Initially, investigators were considering the incident as a potential suicide.
However, as inquiries advanced, numerous facts and evidence reportedly surfaced, casting significant doubts on this initial conclusion.
During judicial proceedings, the court posed challenging inquiries to the investigative agencies, questioning why provisions of the POCSO Act were not activated given that the victim was a minor and the case hinted at a possible sexual assault.
In light of the court's critical remarks, the Bihar government reassessed the situation and issued an amended notification incorporating the POCSO sections.
The incident occurred at the Shambhu Girls Hostel in the Chitragupta Nagar region of Patna, where numerous students reside while preparing for competitive exams like the National Eligibility cum Entrance Test (NEET).
The student was discovered unconscious in her hostel room on January 6. The hostel management and fellow students quickly transported her to a hospital, where medical professionals described her condition as dire.
Despite receiving treatment, the student tragically passed away on January 11, after five days in medical care.
This death has sent shockwaves through the community. The victim's family has consistently claimed that she was a victim of rape and murder, asserting that their daughter was subjected to a grave crime and that efforts were underway to misrepresent the case as suicide.
Conversely, the initial police investigation leaned towards the possibility of suicide.
With the addition of the POCSO sections and the case's transfer to the CBI, the investigation's scope is now significantly broader.
The CBI will not only ascertain the precise cause of death but also explore whether the student was a victim of sexual assault.
