Notably, despite Sharad Kapoor presenting WhatsApp screenshots, the Khar police have not taken action against him. In a similar case, another accused was arrested within 24 hours under the same section 79.”
Khan further criticized the selective enforcement of the law, stating, “The law should not be applied at an officer's discretion. They need to provide justification. Moreover, the chargesheet incorrectly claims that the accused was arrested and presented in court.”
He emphasized, “This statement in the chargesheet is a significant falsehood. We also raised concerns about the issuance of a summons notice to the accused after his purported arrest, under section 35, which was previously 41A. The accused has not provided his statement as required. The police have displayed unwarranted authority, breaching existing Supreme Court laws. The FIR was lodged by the woman in 2024, and over a year has passed without the accused being apprehended. The police have also invoked section 67A of the Information Technology Act, which carries a penalty of five years.”
