Mumbai, Feb 24 (NationPress) A woman alleging molestation by actor Sharad Kapoor has approached the Bombay High Court to request the transfer of her case to the Crime Branch. Additionally, she has called for the suspension of the police officer involved in the investigation.

The 32-year-old complainant asserts that Kapoor summoned her to his residence under the guise of discussing a project, where he subsequently molested her.

Ali Kaashif Khan, the advocate representing the complainant, informed IANS, “The woman has initiated a petition against the police complaint authority, along with senior police inspector Karkay and the investigation officer. Notices have been issued, evidence has been recorded, and cross-examinations have occurred, yet the case remains closed. Notably, despite Sharad Kapoor presenting WhatsApp screenshots, the Khar police have not taken action against him. In a similar case, another accused was arrested within 24 hours under the same section 79.”

Khan further criticized the selective enforcement of the law, stating, “The law should not be applied at an officer's discretion. They need to provide justification. Moreover, the chargesheet incorrectly claims that the accused was arrested and presented in court.”

He emphasized, “This statement in the chargesheet is a significant falsehood. We also raised concerns about the issuance of a summons notice to the accused after his purported arrest, under section 35, which was previously 41A. The accused has not provided his statement as required. The police have displayed unwarranted authority, breaching existing Supreme Court laws. The FIR was lodged by the woman in 2024, and over a year has passed without the accused being apprehended. The police have also invoked section 67A of the Information Technology Act, which carries a penalty of five years.”
