The Opposition Indian National Congress (Congress) on Tuesday, 25 August launched a sharp offensive against the Bharatiya Janata Party (BJP)-led Madhya Pradesh government, accusing it of deliberately shielding state minister Vijay Shah by withholding prosecution sanction — despite a Supreme Court-monitored Special Investigation Team (SIT) completing its inquiry into Shah's controversial remarks targeting Army officer Colonel Sofiya Qureshi.

Congress Leaders Mount Coordinated Attack

Madhya Pradesh Congress president Jitu Patwari and Leader of Opposition Umang Singhar led the charge, both posting on X (formerly Twitter) to amplify their allegations. Patwari wrote: “First, the insult to the Army; now shielding those who committed offences against the Army! By making objectionable remarks about Colonel Sofiya Qureshi, Minister Vijay Shah insulted the Indian Army and a brave daughter of the nation. Now, by attempting to shield him, the Mohan government has made it clear that for them, a minister’s chair matters more than respect for a soldier.”

Singhar was equally pointed, writing: “Regarding the case involving Vijay Shah’s objectionable remarks, the Supreme Court-monitored SIT has been seeking sanction for prosecution for the past year, yet the Cabinet is refusing permission. On public platforms, there is talk of respecting women, but in the Cabinet, decisions are made to shield a minister. Why does the BJP prioritise defending its minister over honouring Colonel Sofiya Qureshi, who brought glory to the nation through Operation Sindoor?”

What the SIT Has Found and Sought

According to reports, the SIT has completed its investigation and formally sought sanction to prosecute Shah under Section 196(1)(a) of the Bharatiya Nyaya Sanhita (BNS). Under law, government sanction is a mandatory prerequisite before criminal proceedings can be initiated against a sitting public servant in such matters.

The Congress attacks came on the same day that Chief Minister Mohan Yadav-led Cabinet convened. As of the time of reporting, neither the state government nor the BJP had issued any response to the allegations.

The Controversy: What Vijay Shah Said

The case originates from May 2025, when Shah, while addressing a public gathering in Mhow near Indore, made remarks widely interpreted as linking Colonel Qureshi — who had publicly briefed the media during Operation Sindoor — with the community associated with terrorists behind the Pahalgam attack. The remarks triggered immediate public outrage and demands for his resignation.

The Madhya Pradesh High Court took suo motu cognisance of the matter, criticised the language used, and directed registration of an FIR. The Supreme Court subsequently constituted the SIT and has repeatedly questioned the state government over its failure to sanction prosecution.

A Pattern of Delays Under Supreme Court Watch

The Supreme Court’s scrutiny has been persistent and increasingly pointed. On 19 January, the apex court gave the government a two-week deadline to decide on prosecution sanction. When no action followed, it issued another directive in May, allowing a further four weeks for compliance. An office report in July noted that no documents had been filed — underscoring what critics describe as a pattern of deliberate inaction.

Shah has apologised on multiple occasions, attributing his remarks to “patriotic fervour” and insisting he meant no disrespect to Colonel Qureshi or the armed forces. The Supreme Court has previously questioned the sincerity of those apologies.

Why This Case Carries National Weight

The case has acquired significance well beyond state politics. Colonel Qureshi was among the senior officers who publicly addressed the nation during Operation Sindoor, the military response following the Pahalgam terror attack — making remarks targeting her particularly sensitive in the context of civil-military relations. With the SIT report submitted and multiple Supreme Court deadlines passed without action, pressure on the Madhya Pradesh government is set to intensify at the next hearing.
