Delhi Court Orders Urgent Surgery for Tahir Hussain Within 15 Days
Synopsis
Key Takeaways
New Delhi, March 20 (NationPress) A Delhi court has mandated that the authorities facilitate surgical intervention for former Aam Aadmi Party (AAP) councillor Tahir Hussain, who is implicated in the 2020 North-East Delhi riots "larger conspiracy" case, to address an inguinal hernia within a timeframe of 15 days.
During the proceedings, Additional Sessions Judge Sameer Bajpai instructed the Delhi Police to ensure that Hussain receives the necessary surgical treatment and adequate post-operative care both in the hospital and afterwards in jail.
Hussain faces charges under the Unlawful Activities (Prevention) Act (UAPA) and various sections of the Indian Penal Code (IPC) for his alleged involvement in the conspiracy that led to the communal violence in North-East Delhi in February 2020.
In his recent application, Hussain requested interim bail on medical grounds, arguing that he requires urgent surgical attention that cannot be sufficiently provided in the jail's medical facility.
Previously, the court had issued a notice regarding his plea and requested responses from the Delhi Police as well as jail officials, directing them to provide a comprehensive report on his medical situation.
The court's order emphasized the necessity for the surgery to occur within the specified timeline, ensuring proper medical care during his recovery.
Hussain’s previous bail application in this case has been denied, with the court noting that the allegations against him are prima facie credible.
Additionally, he is implicated in other cases associated with the riots, including the murder of Intelligence Bureau officer Ankit Sharma, for which he has also been denied bail by the Delhi High Court. The trial court has established charges against him and other defendants under various legal provisions, including those related to murder and criminal conspiracy.
