Tahir Hussain Requests Temporary Bail on Health Grounds in Delhi Riots Case
Synopsis
Key Takeaways
New Delhi, March 18 (NationPress) Former Aam Aadmi Party councillor Tahir Hussain, who is implicated in the 2020 North-East Delhi riots 'larger conspiracy case', has filed a petition in a Delhi court requesting interim bail due to health concerns.
Facing serious charges under the Unlawful Activities (Prevention) Act (UAPA) and multiple sections of the Indian Penal Code, Hussain is seeking temporary relief based on his medical condition.
Additional Sessions Judge Sameer Bajpai at the Karkardooma Courts has acknowledged the plea and has requested a response from the Delhi Police.
The court has also instructed prison authorities to provide a report concerning Hussain's health status.
'A copy of the application, along with a notice, should be delivered to the concerned Superintendent of Prison for a health report on the accused. The prosecution should also be notified,' stated the court order issued on Tuesday.
Previously, Hussain's regular bail application was denied, with the court noting that the accusations against him appear to be prima facie valid.
He is alleged to be involved in a larger conspiracy related to the communal unrest that erupted in North-East Delhi in February 2020.
Many other individuals, including student activists, have also been charged under the UAPA and IPC for their supposed role in inciting the riots.
In a separate matter, the Delhi High Court had previously denied bail to Hussain concerning the murder of Intelligence Bureau officer Ankit Sharma during the riots.
The trial court has initiated charges against him and others under various criminal laws, including murder and conspiracy.
In a related matter, the Supreme Court had earlier granted him custody parole to participate in the 2025 Delhi Assembly elections.
A bench led by Justice Vikram Nath permitted Hussain to leave jail for 12 hours each day under police supervision from January 29 to February 3, while prohibiting him from making any public statements regarding the ongoing cases against him.
