New Delhi, Nov 3 (NationPress) A Delhi court has granted relief by discharging former Coal Secretary H.C. Gupta, former Joint Secretary (Coal) K.S. Kropha, and three additional officials from a corruption case tied to alleged irregularities in the allocation of the Fatehpur East coal block in Chhattisgarh.
Special Judge Dheeraj Mor of the Rouse Avenue District Court issued the ruling following a chargesheet filed by the Central Bureau of Investigation (CBI), which accused the former government officials along with RKM Powergen and its director and managing director, of criminal conspiracy, fraud, and corruption under the Indian Penal Code (IPC) and the Prevention of Corruption Act.
In its decision, the court indicated that no prima facie evidence existed to imply any criminal intent by Gupta, Kropha, or the members of the 35th Screening Committee that recommended the allocation of the Fatehpur East coal block to RKM Powergen.
The court noted that the allocation process was conducted after thorough consideration of recommendations from both the Union Ministry of Power and the Chhattisgarh state government.
The CBI alleged that RKM Powergen secured the coal block by presenting false claims regarding its financial capability and readiness to establish the proposed power plant, while senior officials in the Coal Ministry neglected to properly review its documentation.
The prosecution also accused the company of utilizing forged documents, including fake consent letters for land acquisition and a spurious detailed project report. Concluding that the allegations did not justify the formulation of charges, the court ordered the discharge of all five accused.
"All five accused individuals, namely (i) M/s R.K.M. Powergen Pvt Ltd; (ii) Smt. Dr. Andal Arumugam; (iii) Sh. T.M. Singaravel; (iv) Sh. Harish Chandra Gupta; and (v) Sh. Kuljeet Singh Kropha, are entitled to be discharged for the respective offences alleged against them in the charge sheet. Accordingly, they all are ordered to be discharged," the order stated.
This represents another significant victory for former Coal Secretary Gupta, who has faced trials in various coal block allocation cases.
