Did a Delhi Court Order the Chargesheet Supply in the BMW Accident Case?
Synopsis
Key Takeaways
New Delhi, Feb 2 (NationPress) A Delhi court has mandated the provision of the chargesheet to the accused, Gaganpreet Kaur, in the notorious Dhaula Kuan BMW accident case, which tragically resulted in the death of a senior official from the Finance Ministry.
The ruling was issued by Judicial Magistrate First Class Ankit Garg after Gaganpreet Kaur appeared at the Patiala House Court following a previous summons. The case is scheduled for document examination on February 20.
On January 23, the court acknowledged the chargesheet submitted by the Delhi Police and summoned the accused for her initial appearance.
In its observation, the magistrate noted: “I have reviewed the chargesheet and the accompanying documents. It indicates the commission of an offence. I recognize the offence and will issue a summons to the accused for the subsequent hearing.”
The chargesheet accuses her under various sections of the Bharatiya Nyay Sanhita (BNS), including Sections 105 (culpable homicide not amounting to murder), 281, 125B, and 238A.
The prosecution claims that the incident occurred on September 14, 2025, in the Dhaula Kuan region, when the BMW, reportedly driven by Gaganpreet Kaur, collided with a motorcycle, leading to the death of Navjot Singh, the Deputy Secretary in the Finance Ministry, and serious injuries to his spouse.
The Delhi Police argued that the accident resulted from the accused's negligence, as she allegedly transported the injured victim to a far-off hospital, missing the critical “golden hour.”
According to the chargesheet, timely medical assistance could have saved the victim's life. Instead of being taken to closer hospitals like AIIMS or the Army Base Hospital, which were only about 10–15 minutes away, the victim was taken to Nulife Hospital in North Delhi, approximately 23 minutes from the scene, causing a fatal delay.
CCTV footage obtained during the investigation has been utilized by the prosecution to corroborate the timeline of events following the accident.
