Supreme Court Acknowledges Controversial Remarks by Allahabad High Court Judge

New Delhi, Dec 10 (NationPress) The Supreme Court has acknowledged the contentious remarks made by Justice Shekhar Kumar Yadav, who serves as a judge in the Allahabad High Court.

"The Supreme Court has acknowledged the reports in the media regarding a speech delivered by Mr. Justice Shekhar Kumar Yadav, a judge of the High Court of Judicature at Allahabad. Details are being gathered from the High Court and the issue is currently under review," stated a release from the apex court.

During a provincial gathering of the Vishwa Hindu Parishad's law Cell (Kashi Province) on Sunday, Justice Yadav allegedly remarked that the "nation will operate according to the preferences of the 'bahusankhyak' (majority) residing in Hindustan".

"I express no reluctance in asserting that this is Hindustan, and this nation will operate based on the desires of the majority present here. This is the law. It is not merely a matter of speaking as a High Court Judge; rather, the law functions in alignment with the bahusankhyak (majority). Reflect on this in the context of a family or community - only what promotes the well-being and happiness of the majority will be recognized," Justice Yadav reportedly stated, according to media sources. Furthermore, he reportedly added: "Lekin yeh jo kathmullah hai jo...yeh sahi shabd nahi hai...lekin kehne mein parhez nahi hai kyunki woh desh ke liye bura hai...desh ke liye ghatak hai, khilaaf hai, janata ko bhadhkane wale log hai...desh aage na badhe is prakar ke log hai...unse saavdhaan rehne ki zaroorat hai (But these kathmullah... this may not be the right word... but I won't hesitate to say it because they are harmful to the country...they are detrimental, against the nation, and people who incite the public. They are the kind of people who do not want the country to progress, and we need to be cautious of them)."

Earlier on Tuesday, advocate Prashant Bhushan, acting as the convenor of the Campaign for Judicial Accountability and Reforms (CJAR), urged the Chief Justice of India to initiate an "in-house enquiry" against Justice Yadav for "judicial impropriety" and for "contravening the code of conduct for judges".

Bhushan asserted that Justice Yadav employed "unforgivable and unconscionable insults against the Muslim community, tarnishing the reputation of the High Office of a Judge of the Allahabad High Court and the Judiciary overall, besides undermining the rule of law that he is supposed to uphold".

"His involvement in this right-wing event, along with his statements, grossly violate Articles 14, 21, 25 & 26, in conjunction with the Preamble of our Constitution. They are discriminatory and breach the fundamental principles of secularism and equality before the law embedded in our Constitution. Such communally charged remarks at a public gathering by a sitting judge of the High Court not only offend religious sentiments but also severely erode public confidence in the integrity and impartiality of the judicial system. Such a speech is also a blatant violation of his oath as a judge, where he pledged to uphold the Constitution and its values impartially," the letter from CJAR stated.
