Supreme Court Attorney Files Complaint Against Rahul Gandhi, Calls for Expulsion

New Delhi, Dec 20 (NationPress) An attorney representing the Supreme Court submitted a formal complaint on Friday against Congress leader Rahul Gandhi for purportedly committing criminal acts of physical assault and incitement against BJP MPs inside the Parliament.

In a petition directed to the Speaker of the Lok Sabha, the complainant noted that on Thursday, while Members of Parliament from the National Democratic Alliance (NDA) were peacefully protesting at the Makar Dwar entrance of Parliament against the overt misinformation spread by opposition parties, particularly those led by the Indian National Congress, Rahul Gandhi, the Leader of the Opposition (LoP), allegedly physically harmed NDA MPs.

“Around 10:40 AM to 10:45 AM, Mr. Rahul Gandhi arrived at the scene. Despite security personnel's requests to follow the designated entry route, Mr. Gandhi, with the intent to disrupt the protest and physically harm NDA Members of Parliament, disregarded these instructions and forcefully approached the peaceful demonstrators,” the complaint filed by attorney Vineet Jindal stated.

The complaint further mentioned that not only did Rahul Gandhi and his associates breach security directives, but he also incited other members of the INDIA bloc to act aggressively towards NDA MPs, putting their safety at risk.

“The members of the INDIA alliance intentionally used physical force against Members of Parliament Mukesh Rajput and Pratap Rao Sarangi, who were positioned on the narrow stairs at the entrance. Consequently, Mukesh Rajput suffered a serious injury to the back of his head, while Pratap Rao Sarangi incurred a forehead injury,” the complainant elaborated.

He added that the assault perpetrated by LoP Gandhi and his supporters reflects a lack of respect for the rules of conduct and parliamentary decorum.

Had Rahul Gandhi engaged in such behavior outside of Parliament, he would have faced criminal charges under various sections of the BNS Act, and an FIR would have been lodged against him. The complaint asserted that he has exploited the privileges granted to Members of Parliament during the Lok Sabha session to evade criminal accountability.

Furthermore, it stated that the Speaker of the Lok Sabha holds the power to penalize members for misconduct, whether inside or outside the House, and by participating in violent actions, he has violated parliamentary privilege.

According to the Rules of Conduct and Parliamentary Etiquette, in instances of severe misconduct, if an MP's actions are found to undermine the dignity of the House and its members, the House may take steps to expel the member.

The complainant urged that immediate action be taken against Rahul Gandhi and others implicated for breach of privilege, contempt of the House, and physical assault and incitement, and requested that Gandhi and others be considered for suspension or expulsion from the Lok Sabha in accordance with established rules.
