Srinagar, March 12 (NationPress) Just a few hours after the issuance of a non-bailable warrant against former Chief Minister of Jammu and Kashmir, Farooq Abdullah, in relation to the J&K Cricket Association (JKCA) scam, the Chief Judicial Magistrate (CJM) of Srinagar decided to revoke the warrant on Thursday.
The CJM explained that the revocation was made in light of Abdullah's health condition following a violent attack the previous day.
Earlier, the CJM had issued the warrant because Abdullah did not attend court in person or via video link.
Abdullah's lawyer, Ishtiyaq Khan, filed a petition requesting the withdrawal of the warrant, arguing that medical professionals had advised against travel after the serious attack on his client in Jammu last night.
“Although the applicant survived the assassination attempt, the physical and psychological trauma has significantly worsened his existing medical issues, including irregular blood pressure and heart distress,” the attorney stated in the petition.
Khan emphasized that following the attack, Abdullah was under constant medical supervision and a “Restricted Security Protocol.”
His medical team has strictly forbidden any form of travel, especially between Jammu and Srinagar, due to the severe risks it poses to his health and life.
“Given these overwhelming circumstances, the applicant was unable to appear before this esteemed court today,” he argued.
Previously, the court had denied Abdullah’s request for exemption from personal appearance. It also rejected a similar request from another defendant, Manzoor Gazanfar Ali, leading to a non-bailable warrant being issued against him as well.
The Central Bureau of Investigation (CBI) had earlier submitted a chargesheet against various individuals, including Farooq Abdullah, under Sections 120-B, 406, and 409 of the Ranbir Penal Code (RPC) concerning the alleged scam, as reported by official sources.
The CBI's investigation has centered on allegations of embezzlement within the JKCA, claiming that funds designated for cricket development were misused during Abdullah's presidency.
Other accused individuals include former JKCA officials Ahsan Ahmad Mirza, Mohd Saleem Khan, and Bashir Ahmad Misgar.
The case has been in progress for some time, with the CBI charging various parties with a multi-crore fund misappropriation. The recent court developments signify an important step towards trial, following extensive inquiries into financial misconduct.
