New Delhi, Jan 9 (NationPress) Delhi Speaker Vijender Gupta announced on Friday that the Assembly has officially acknowledged the FIR lodged by Punjab Police against Minister Kapil Mishra, stemming from an unauthorized video recording of the House proceedings.
This video, allegedly associated with claims of disrespect towards Sikh Gurus by AAP leader Atishi, was brought to attention by Laxmi Nagar MLA Abhay Verma from the BJP.
The FIR, filed by Jalandhar Police, is based on the video related to the Atishi incident in the Delhi Assembly, which the Punjab Police downloaded from Mishra’s X handle and subjected to forensic analysis, declaring it “tampered” before taking action against Mishra.
Speaker Gupta asserted that the matter raised by Verma constitutes a breach of privilege of the Assembly.
“The FIR is based on a video that records the Assembly proceedings and is the property of the Assembly. Taking such actions against a Minister based on this video is a grave matter. This presents a clear case of breach of privilege against the Police Commissioner of Jalandhar,” Gupta stated.
He emphasized that recordings made inside the Assembly exclusively belong to the Assembly.
“It is crucial to understand the basis on which this case was registered. The House will review the issue and consider appropriate actions against the Police Commissioner of Jalandhar due to unwarranted interference with the Assembly’s property,” added Speaker Gupta.
This video is indeed the Assembly's property, recorded within its confines. In response to the Opposition's demand, the matter was referred to the Forensic Science Laboratory for verification,” noted the Speaker.
Labeling the recording as “tampered” undermines the dignity of the Assembly, and anyone found complicit in this conspiracy will face strict consequences from the House, according to the Speaker, who confirmed, “The House is formally taking cognizance of the entire issue.”
Mishra accused AAP National Convenor Arvind Kejriwal of exploiting Punjab Police to file a false FIR against him to intimidate and silence him.
In a message posted on X, Mishra stated, “Mr. Kejriwal, your FIR and the threat from the police won't intimidate us. The Assembly has the video, and the entire world has heard it… since then, Atishi has avoided attending the Assembly despite several calls from the Speaker.”
“The Punjab Police, neglecting crime investigations in Punjab, is attempting to cover up the wrongdoing of your Leader of the Opposition. Atishi has committed an offense, and in trying to protect her, you are committing an even greater transgression,” Mishra conveyed.
He referenced the claims made by Jalandhar Police that Atishi did not use inflammatory language in the Delhi Assembly.
Previously, the Jalandhar Police had focused on a specific video clip sourced from Mishra's social media profile, which was sent to the Director of the Forensic Science Laboratory (FSL) in Punjab, SAS Nagar. The investigation concluded that the video had been intentionally “doctored,” leading to the FIR being filed against Mishra.
