What Changes Are Proposed in the Revised Maharashtra Special Public Security Bill?

Mumbai, July 10 (NationPress) Chief Minister Devendra Fadnavis unveiled the Maharashtra Special Public Security Bill, 2024, on Thursday, following the recommendations of the joint select committee. Initially introduced during last year's winter session, the bill was reviewed by a committee led by revenue minister Chandrashekhar Bawankule, which proposed several amendments in its report.

The newly revised bill is designed to combat specific unlawful activities associated with left-wing extremist groups or similar entities. Notably, there was no opposition recorded in the committee's findings.

CM Fadnavis staunchly defended the bill’s introduction, clarifying that its intent is not to target individuals unfairly but to act against those who foment unrest against the Indian Constitution. He assured that journalists or political figures will not face repercussions under this law. The bill is fundamentally about the security of the nation and the state, aimed at thwarting those who threaten constitutional integrity.

As per the amendments put forth by the joint select committee, the original title, 'A Bill to prevent illegal activities of individuals and organisations', has been updated to 'A Bill to prevent illegal activities of extremist, left-wing extremist organisations or similar organisations'. Furthermore, the objective has shifted from addressing 'certain unlawful activities of individuals and organisations' to focusing specifically on 'certain unlawful activities of left-wing extremists or similar organisations.'

The bill also introduces the establishment of an advisory board that will have the authority to designate an organization as unlawful. This board will include a sitting or retired High Court justice as chairperson, a retired district judge, and a High Court public prosecutor, expanding upon the previous composition which only included a High Court justice or their equivalent.

Moreover, the legislation stipulates that crime investigations will be conducted by officers at least of the rank of Deputy Superintendent of Police, addressing concerns raised in committee meetings. Previously, investigations were handled by officers of lower ranks, such as Police sub-inspectors.

According to the bill, unlawful activity encompasses any action—whether through speech, writing, sign, visual representation, or otherwise—that poses a threat to public order, peace, and tranquility, thereby disrupting the enforcement of law or affecting its institutions and personnel.
