“The film's title lacks any adjectives or words that would cast the Yadav community in a negative light. The concerns expressed are entirely unfounded,” the Supreme Court stated while dismissing the case. The court also clarified its earlier remarks regarding the film previously titled 'Ghooskhor Pandat', asserting that this case is notably different.
Distinguishing between the two cases, the Justices indicated that the term 'ghooskhor' (which translates to corrupt) carries a negative connotation towards a specific community, while no such derogatory implication exists in this instance.
“In this case, there is no negativity associated with the Yadav community. None of the reasonable restrictions under Article 19(2) apply,” stated the apex court.
The petition, submitted by advocate Makardhvaj Yadav, sought to prevent the film's release, arguing that the use of the caste identifier 'Yadav Ji' in the title could perpetuate stereotypes and disrupt social harmony.
The petitioners asserted that the anticipated release has already sparked organized protests, appeals to local authorities, and public demonstrations from members of the Yadav community across various regions of the country.
Despite being framed as a fictional romantic drama, it was contended that the film's title and themes might exacerbate social polarization given the current socio-political climate.
The petition urged for urgent judicial intervention before the film's scheduled nationwide release on Friday, emphasizing that any damage to community dignity would be irreparable if the film is released without judicial review.
