Mumbai, July 20 (NationPress) Mohammed Shariful Islam (30), who is accused of attacking Bollywood star Saif Ali Khan at his residence in Mumbai earlier this January, has submitted a bail application.
He asserts that the FIR lodged against him is merely a "fabricated narrative" without substantial evidence to support it.
The court has set the next hearing for July 21. Currently, Islam is detained in Mumbai's Arthur Road jail. In his bail petition, filed through attorney Vipul Dushing, he maintains his innocence and notes that he has no prior criminal history.
The petition states that the investigation is nearly concluded, with only the charge sheet pending. It highlights that significant evidence, such as CCTV footage and call records, is already available to the prosecution. Furthermore, it claims there is no risk of evidence tampering or witness intimidation.
He expressed, “The current FIR is merely a fabricated tale by the complainant. Therefore, I am requesting bail.”
Additionally, the application raises issues regarding the legality of his arrest, citing a violation of Section 47 of the Indian Civil Defence Code (BNSS), which stipulates that an arrested individual must be informed of the reasons for their arrest and their right to bail. The case has been postponed until July 21.
Earlier this January, the actor was stabbed multiple times while attempting to fend off a burglar. The incident occurred at around 2:15 am when the intruder allegedly entered their Bandra home, attacked the house help, and subsequently attacked Saif when he intervened.
Saif was alerted by noise coming from his son Jeh’s room. When he entered, he found the assailant in a confrontation with their house help. In an effort to protect the house help, Saif intervened, confronting the intruder barehanded.
