Kolkata, Jan 22 (NationPress) The West Bengal government faced a significant setback on Wednesday when a single-judge bench of the Calcutta High Court issued an interim stay on the ongoing police investigation against Asfakullah Naiya, a prominent figure in the R.G. Kar movement.

Naiya serves as an ENT specialist at a private healthcare facility in the state, although he lacks the requisite qualifications for this role.

The interim stay will remain in effect for six weeks. The judge, Justice Tirthankar Ghosh, determined that the state police initiated their investigation by filing an FIR without substantial evidence or documentation supporting the claims made.

The bench also raised concerns regarding the initiation of police proceedings based on a complaint from a third party rather than from any patient directly affected.

Naiya had approached Justice Ghosh on Monday to contest the summons issued by the state police.

His petition was accepted on the same day, and after two consecutive hearings on Tuesday and Wednesday, the judge ultimately granted the interim stay on the police actions against him.

Naiya is currently pursuing his post-graduation in ENT at R.G. Kar.

On January 16, the West Bengal Medical Council issued a show-cause notice to Naiya in response to a complaint regarding his practice as an ENT specialist in a private medical service, despite his lack of proper qualifications.

That same day, the Bidhannagar City Police summoned him concerning the same allegations, and police officers visited his home in Kakdwip, located in the South 24 Parganas district. However, Naiya was at the R.G. Kar hostel at that time.
