Calcutta HC Delays Action on Parents' Plea for New Investigation into RG Kar Incident

Kolkata, Dec 24 (NationPress) The Calcutta High Court stated on Tuesday that it will refrain from addressing the petition for a new investigation into the heinous rape and murder of a female junior doctor at R.G. Kar Medical College & Hospital in August of this year until certain issues are resolved.
During the hearing at the single-judge bench led by Justice Tirthankar Ghosh, he emphasized the necessity for clarification regarding whether the ongoing investigation by the Central Bureau of Investigation (CBI) is subject to monitoring by the Supreme Court.
The next hearing is set for January 15 of the following year, by which time the petitioners must obtain clarifications either from the apex court or a division bench of the Calcutta High Court.
Justice Ghosh remarked, 'There is no issue in proceeding with the matter. However, it is essential to clarify whether the investigation is court-monitored.'
On Tuesday, the CBI's counsel informed Justice Ghosh's bench that the investigation by the central agency is being overseen by the country's apex court. In contrast, the petitioners' counsel disputed this assertion.
Subsequently, Justice Ghosh requested clarification on this conflicting information from either the Supreme Court or a division bench of the Calcutta High Court before further hearings.
In response to the court's remarks, the victim's father told the media that he is willing to go to great lengths to achieve justice for his daughter.
'There may be some delays in the process. However, we will wait patiently. My sole objective is to secure justice for my daughter by any means necessary,' he stated.
On December 19, the victim's parents approached Justice Ghosh's bench seeking direction for a fresh investigation. They expressed a lack of faith in the current investigation being conducted by the central agency and requested a new inquiry from the beginning.
Following a special court in Kolkata granting default bail to two individuals accused of evidence tampering, the victim's parents and representatives from the state's medical community have accused the CBI of significant incompetence in this case.
The two accused individuals include the former principal of R.G. Kar, Sandip Ghosh, and the former SHO of Tala Police Station, Abhijit Mondal. Ghosh remains incarcerated due to a parallel investigation by the CBI regarding financial irregularities at R.G. Kar, while Mondal has been released on bail.
The CBI has so far filed only one charge sheet, identifying civic volunteer Sanjay Roy as the 'sole prime accused' in the rape and murder.
Recently, the victim's parents have also changed their legal representation at the Supreme Court.
