Kolkata, March 28 (NationPress) The Central Bureau of Investigation (CBI) is set to present the case diary in the RG Kar rape and murder case today before the Calcutta High Court’s single-judge bench presided by Justice Tirthankar Ghosh.

This session marks a new hearing following the Supreme Court's green light earlier this month.

As the second day of this renewed hearing unfolds, all eyes will be on the proceedings to determine if the CBI counsel can clarify the court's previous inquiry regarding whether the incident was classified as “rape” or “gang-rape.”

During the initial hearing on March 24, Justice Ghosh instructed the CBI to elaborate on its stance concerning the “rape versus gang-rape” discussion.

Moreover, while requesting the case diary, Justice Ghosh also called for clarification on whether the ongoing investigation pertains solely to “evidence tampering and altering,” or if there are additional suspects involved in the principal crime of rape and murder, apart from the already convicted civic volunteer, Sanjay Roy.

Recently, a special court in Kolkata found Sanjay Roy guilty, marking him as the only convict in the case of rape and murder, sentencing him to life imprisonment. However, the CBI has approached the Calcutta High Court, contesting the special court's ruling and seeking a harsher sentence for Roy.

On March 24, during the initial hearing at Justice Ghosh’s bench, the West Bengal government counsel and four-time Trinamool Congress Lok Sabha member Kalyan Banerjee took a “tactically balanced stand” regarding the matter.

In his submission, Banerjee indicated that the state government does not oppose any new investigations, but raised concerns about the legal validity of such a probe following the special court's sentence for Sanjay Roy.

It is important to note that the Supreme Court recently permitted a parallel hearing in the case at the Calcutta High Court, prompting the victim's parents to file a fresh petition with Justice Ghosh’s bench.

Justice Ghosh accepted the case, scheduling March 24 as the first day of the new hearing.

Initially, when the victim's parents approached Justice Ghosh, he was reluctant to hear the case as it was already under consideration at the apex court. However, following the Supreme Court's endorsement, concurrent hearings can now take place at both the apex court and the high court, in addition to the ongoing proceedings at a special court in Kolkata.

The body of the junior woman doctor was discovered in a seminar hall on the grounds of R.G. Kar Medical College and Hospital on the morning of August 9 last year.

The case was initially investigated by a special investigation team from the Kolkata Police, which resulted in the arrest of the sole convict, civic volunteer Sanjay Roy. The investigation was subsequently transferred to the CBI following an order from the Calcutta High Court.
