Delhi court convicts Tahir Hussain for abetment to rioting in 2020 Delhi riots
Synopsis
Key Takeaways
A Delhi court on Saturday, 10 October convicted former Aam Aadmi Party (AAP) councillor Tahir Hussain of abetment to rioting in a case stemming from the 2020 North-East Delhi communal violence, while acquitting him of all other charges in the matter. Seven co-accused were cleared of all charges. This marks Hussain's second conviction linked to the February 2020 riots.
What the Court Decided
Additional Sessions Judge Praveen Singh of the Karkardooma Court held Hussain guilty in connection with the looting and burning of a shop in the Dayalpur area on 24 February 2020, during the communal unrest that swept North-East Delhi. The court acquitted him of all remaining charges in the case, and all seven other accused were similarly acquitted of every charge against them.
Arguments on the quantum of sentence have been scheduled for 16 November.
The Underlying Complaint
The case originated from a complaint filed by a shopkeeper in Dayalpur, who alleged that his establishment was looted and set ablaze on 24 February 2020. According to the complaint, goods worth ₹17–18 lakh were stolen and property damage was estimated at ₹10 lakh. An FIR was registered at Dayalpur police station under multiple sections of the Indian Penal Code (IPC), including Sections 147 (rioting), 148 (rioting armed with a deadly weapon), 149 (unlawful assembly), 427 (mischief causing damage), 436 (mischief by fire or explosive substance with intent to destroy a house), and 120B (criminal conspiracy).
Hussain's Prior Conviction and Ongoing Appeal
This is not Hussain's first brush with a conviction over the 2020 riots. He is already serving a life sentence after the Karkardooma Court found him and four others — Javed, Anas, Nazim, and Kasim — guilty in the murder of Intelligence Bureau (IB) officer Ankit Sharma. Six other accused were acquitted in that case.
Hussain has challenged both his conviction and life sentence before the Delhi High Court. In September, the High Court issued notice to the Delhi Police on his appeal and directed that it be heard alongside connected appeals filed by other convicts on 2 December.
Scale of the 2020 North-East Delhi Violence
The communal violence that engulfed North-East Delhi in February 2020 was among the worst seen in the capital in decades. The riots claimed 53 lives, left several others injured, and caused extensive damage to homes, shops, and public property across multiple neighbourhoods. Scores of cases relating to the violence remain at various stages of trial across Delhi courts.
What Comes Next
With the sentencing hearing fixed for 16 November, the court will determine the punishment for Hussain's abetment to rioting conviction. His life sentence appeal before the Delhi High Court is separately listed for 2 December. Legal observers note that the partial acquittal on other charges may influence arguments on sentencing, even as the broader judicial process around the 2020 riots continues to unfold.
