Lawyer of Prashant Kishor Alleges Unlawful Transfer to Beur Jail by Patna Police

Patna, Jan 10 (NationPress) The situation surrounding the detention and later attempted imprisonment of Jan Suraaj Party President Prashant Kishor by Patna police has incited strong backlash from his attorney, Amit Kumar.

Kumar alleged that the Patna police tried to transfer Kishor to Beur Jail on January 6 without the necessary custody documentation.

He stated that the Jail Superintendent denied admission to Kishor due to the absence of proper custody papers.

“It was astonishing that while Prashant Kishor was being taken away from the court premises to Beur Jail, the hearing was still active inside the courtroom. They intended to move him without custody papers, but the Jail Superintendent refused to accept him,” Kumar remarked.

Kumar also raised alarms regarding the legal provisions under which the case was registered.

He pointed out that Sections 190, 191(2), 191(3), and 223 — under which Kishor has been charged — are all bailable offenses.

He specifically criticized the usage of Section 191(3), which relates to rioting or the possession of a weapon.

“There wasn't even a stick in the hands of any child. If the Bihar Police views blankets and mufflers as weapons, then they are truly remarkable. This was a Satyagraha; how did it morph into a riot?” Kumar questioned.

The lawyer emphasized the points listed in Prashant Kishor's bailable personal recognizance bond.

The first point indicated Kishor was a suspect in the matter, the second stated that he was to be released on bail by the court.

The third point required Kishor to assist the police and attend court proceedings if the trial advances, while the fourth stated that a fine of Rs 25,000 would be imposed for non-compliance.

Kumar further inquired why Kishor, despite the FIR being filed at Gandhi Maidan police station, was taken straight to Beur Jail.

He claimed that during a peaceful assembly, when the crowd became unruly, Kishor was handed a microphone to address them — an act that led to another FIR being lodged.

“Why won’t the police clarify under what authority they moved him to Beur Jail? We were not provided any documents by the police. They have merely made us victims of falsehoods,” Kumar asserted.

The detention and management of Prashant Kishor by Patna police have ignited considerable controversy, sparking allegations of procedural breaches and excessive force.

Retired IPS officer and Jan Suraaj Party leader Anand Mishra, along with party spokesperson Kishore Kumar Munna, have raised serious issues regarding the actions of the Bihar Police.

Anand Mishra condemned the unprofessional approach of the police, stating that the officers on duty were not in proper uniforms and did not display identification.

He expressed worries about the lack of transparency, stating: “No one knew where they were taking Prashant Kishor. I followed them and observed that none of the police officers had a nameplate, no rank, and no one was wearing a cap. Who can say they aren’t impostors posing as Bihar Police? No one even revealed their identity. Such conduct is not even acceptable with a terrorist.”

Mishra further urged Bihar’s Director General of Police (DGP) to comply with the DK Basu guidelines, set by the Supreme Court, mandating police officers to disclose their identity during detentions.

He added: “When I reminded them of the guidelines, they only then revealed their ranks. This was entirely an illegal detention.”

Party spokesperson Kishore Kumar Munna claimed that Kishor was forcibly taken by the police at 4 a.m. without appropriate documentation.

He stated that Kishor was transferred to AIIMS, where the administration and medical staff were pressured to admit him.

However, AIIMS administration declined, citing insufficient paperwork.

The situation escalated as Prashant Kishor, who has been on a hunger strike since January 2, was later admitted to the ICU ward at Medanta Hospital in Patna due to declining health.

This Thursday marks the eighth day of Kishor's hunger strike.
