The causelist posted on the apex court's website indicates that a bench comprising Justices B.V. Nagarathna and Ujjal Bhuyan will review the petition submitted by Congress leader Jaya Thakur.
The petition asserts that the implementation of the one-third quota for women should not be postponed. It calls for the prompt enforcement of the Nari Shakti Vandan Adhiniyam, which mandates this reservation for women in the Lok Sabha and state Assemblies.
In a prior ruling from November 2023, the Supreme Court noted the challenges in invalidating the legal provision stating that the women’s quota would only be activated following the next decennial Census and the subsequent delimitation process.
The petitioners argue that such prerequisites are unnecessary since the number of seats has already been established, and highlight that women, who make up almost half of the nation’s population, continue to be underrepresented in elected offices.
This hearing is crucial as the Parliament is poised to discuss the Women’s Reservation (Amendment) Bill during a special session starting April 16. Prime Minister Narendra Modi has reached out to leaders of all political parties in both Houses of Parliament, encouraging them to support the unanimous passage of this legislation to enable the implementation of women’s reservation ahead of the 2029 Lok Sabha elections.
In his correspondence, the Prime Minister emphasized the importance of increased female representation in legislative bodies for India’s ambition to become a developed nation and asserted that the time has come to apply the law “in its true spirit” nationwide.
Nonetheless, the proposed special session has faced pushback from the Congress party, which has claimed that this initiative breaches the Model Code of Conduct due to the ongoing Assembly election campaigns in Tamil Nadu and West Bengal. Furthermore, Congress has insisted on convening an all-party meeting regarding delimitation before proceeding with any legislative efforts concerning women's reservation.
