Kolkata, May 3 (NationPress) The government of West Bengal has mandated all public medical facilities in the state to comply with the established legal requirements for the prompt medical examination of suspected minor victims of sexual assault, even prior to the filing of a First Information Report (FIR).
This initiative aims to address the challenges associated with conducting medical assessments of victims under the Protection of Children from Sexual Offences (POCSO) Act by female medical professionals. An official directive was issued by the State Health and Family Welfare Department to the principals and medical superintendents-cum-vice principals (MSVPs) of all medical colleges and hospitals, as well as to chief medical officers of health (CMOH) across all districts and health regions.
According to the order, "The medical examination of a child regarding any offense committed under the Act shall, regardless of whether a First Information Report or complaint has been lodged, proceed according to Section 164A of the Code of Criminal Procedure, 1973 (2 of 1973)."
A senior representative from the State Health Department noted that despite the existing legal framework allowing for medical examinations of suspected minor victims before FIRs are filed, there have been instances of hesitance to comply strictly with this provision.
"This new directive serves as a reminder of the legal obligations in this context, ensuring strict adherence moving forward," the official remarked.
The order also emphasizes that if the victim is a minor girl, a female doctor must conduct the examination.
"The examination should occur in the presence of the child's parent or another trusted individual," the document stated.
West Bengal has faced negative scrutiny since mid-2024 due to various incidents of sexual violence, including cases involving minors.
The most notable incident was the horrific rape and murder of a junior woman doctor at R.G. Kar Medical College and Hospital in Kolkata last August, which occurred within the hospital premises.
