He asserted that the recent breach of protocol in West Bengal was not just an oversight but a constitutional violation. “When a state government intentionally disrespects the highest office in the nation, it forgets that it wields power under an oath to the Constitution,” he stated.
Nishad referred to Articles 52 to 62, which outline the presidency, noting that these offices symbolize the Indian Republic and deserve respect from all.
He further contended that the actions of the West Bengal government also violate Articles 256 and 257, which mandate state governments to adhere to directives from the Centre and maintain constitutional protocol.
Nishad suggested that if a state government willfully disregards the President’s or any constitutional authority’s protocol, it should be regarded as a breakdown of constitutional machinery, leading to proceedings under Article 356. This article allows for the dismissal of a state government if it fails to uphold constitutional provisions or its machinery collapses.
Moreover, he called for a limitation on the discretionary powers of the state in these matters, advocating that officials and ministers accountable for protocol violations should face punitive and criminal repercussions.
He cautioned, “If we overlook the disrespect shown in Bengal today, other states may follow suit tomorrow. We must uphold the supremacy of the Constitution. The office of the President represents the pride of 1.4 billion Indians.”
The controversy surrounding President Murmu’s treatment in West Bengal continues to escalate. The Union Home Secretary has already requested a response from the Chief Secretary of West Bengal, inquiring why protocols were not observed.
During a tribal community event near Bagdogra Airport on Saturday, the President noted the absence of Chief Minister Mamata Banerjee and her ministers and questioned the choice to change the venue. Following this, the Home Secretary demanded an explanation from the West Bengal Chief Secretary regarding the failure to comply with the rules during the President’s visit.
