New Delhi, Dec 27 (NationPress) The Supreme Court is set to review the Central Bureau of Investigation’s (CBI) request on Monday regarding the recent ruling from the Delhi High Court, which has temporarily lifted the life sentence and allowed bail for expelled Bharatiya Janata Party member Kuldeep Singh Sengar in connection with the 2017 Unnao rape case.
According to the causelist available on the apex court's website, a three-judge Vacation Bench, comprising Chief Justice of India (CJI) Surya Kant, along with Justices J.K. Maheshwari and Augustine George Masih, will address the issue on Monday.
The CBI has approached the Supreme Court to contest the December 23 decision from the Delhi High Court, which permitted Sengar’s application for sentence suspension while his appeal is pending.
It has been reported that both the CBI and the victim's family expressed their desire to appeal the High Court's ruling in the Supreme Court.
Previously, the CBI firmly opposed Sengar’s request at the Delhi High Court, emphasizing the serious nature of the crime and the associated risks.
A Division Bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar from the Delhi High Court granted Sengar conditional bail and suspended his life sentence, subject to stringent conditions.
The Bench mandated that Sengar be released on a personal bond of Rs 15 lakh, backed by three sureties of the same amount. Additionally, it ordered that he must not approach within a five-kilometre radius of the victim's residence and remain in Delhi for the duration of his bail.
The Delhi High Court made it clear that any breach of these conditions would result in the revocation of bail.
The Unnao rape case has sparked widespread outrage across the nation.
In December 2019, the trial court found Sengar guilty of kidnapping and raping a minor girl, sentencing him to life imprisonment along with a fine of Rs 25 lakh.
Previously, the Supreme Court had transferred all related cases from Uttar Pradesh to Delhi and directed that the trial proceed on a day-to-day basis.
Meanwhile, relatives of the survivor and women's rights activists have protested against the suspension of Sengar’s sentence, claiming that the bail order undermines public trust and sends a negative message regarding crimes against women.
