New Delhi, May 9 (NationPress) - The Central Consumer Protection Authority (CCPA) has taken a significant step by issuing 13 notices to prominent digital marketplaces including Amazon, Flipkart, Meesho, and OLX. This action targets the unauthorized listing and sale of walkie-talkies on their platforms, which lack essential disclosures regarding frequency, licensing, and Equipment Type Approval (ETA).

The Ministry of Consumer Affairs has noted that walkie-talkies are being offered for sale without the necessary information on wireless operating licenses or compliance with relevant laws.

A preliminary review indicated a concerning number of such listings across these platforms, with around 467 listings on Amazon, 314 on Flipkart, 489 on Meesho, and 423 on TradeIndia, highlighting the widespread nature of this issue.

Union Minister Pralhad Joshi emphasized that the sale of non-compliant wireless devices not only violates legal standards but could also jeopardize national security.

“All sellers must strictly follow applicable regulatory standards to protect consumer rights and prevent illegal trade practices,” the minister stated on the social media platform X.

The affected platforms include Amazon, Flipkart, Meesho, OLX, TradeIndia, Facebook, Indiamart, VardaanMart, Jiomart, Krishnamart, Chimiya, Talk Pro Walie Talkie, and MaskMan toys.

The listings for walkie-talkies fail to clarify whether the devices require a license from the appropriate authority for usage.

“The lack of details such as frequency range, licensing requirements under the Indian Telegraph Act, 1885, and the Wireless Telegraphy Act, 1933, alongside the Use of Low Power, Very Low Power Short Range Radio Frequency Devices (Exemption from Licensing Requirement) Rules, 2018, misleads consumers into thinking that these devices are freely operable by the public,” the ministry stated.

Moreover, the Consumer Protection (E-Commerce) Rules, 2020 mandate that e-commerce entities provide clear and accessible information to help consumers make informed decisions before purchase.

The sale of non-compliant wireless devices without necessary regulatory disclosures misleads consumers and represents a serious breach of legal obligations.

The Central Authority has observed that numerous platforms allow the sale of walkie-talkies without adequately specifying the frequency range, lacking valid Equipment Type Approval (ETA) from the Wireless Planning and Coordination (WPC) Wing, and failing to disclose licensing requirements to consumers.

Consequently, the Central Authority has requested detailed information about each seller, including names and contact information, product URLs, listing IDs of walkie-talkie devices, frequency specifications, any licensing information displayed, ETA/WPC certification verification, and the number of units sold per listing from January 2023 to now.

In light of the pervasive non-compliance by e-commerce entities, the CCPA has deemed it necessary to issue specific guidelines to ensure legal adherence and protect consumer interests.
