US finds Indian oleoresin paprika dumped, subsidised; duties loom

In the parallel countervailing-duty investigation, Synthite Industries was assigned a subsidy rate of 25.42 per cent, while Mane Kancor received a rate of 18.67 per cent. The rate for all other Indian producers and exporters was set at 21.90 per cent. The department said it examined subsidy information supplied by both companies and verified relevant sales, cost, and accounting records between April and June.
Critical Circumstances Finding Against Synthite
Commerce made a finding of 'critical circumstances' concerning Synthite Industries in the subsidy investigation — a designation that allows duties to be applied retroactively. The same finding was not made for Mane Kancor or other Indian producers and exporters.
As a result, the suspension of liquidation — the process through which US Customs and Border Protection makes a final calculation of duties — will continue for covered Synthite imports entered from 8 November 2025 through 5 June 2026. For all other applicable Indian imports, the suspension covers merchandise entered from 6 February through 5 June. Notably, Commerce separately concluded that critical circumstances did not exist in the antidumping portion of the investigation for any of the Indian exporters.

Oleoresin paprika is a concentrated extract produced from capsicum peppers. The highly coloured liquid — generally red or orange — is widely used as a colouring and flavouring ingredient across food, cosmetics, and other consumer products. India is among the world's leading producers of capsicum-based extracts, making this investigation commercially significant for the sector.
What Happens Next
The proceedings are not yet complete. The US International Trade Commission (USITC) must now determine whether imports of the Indian product materially injured or threatened injury to a domestic American industry. The commission is expected to issue its final injury determination within 45 days.
If the commission finds no material injury or threat of injury, the proceedings will be terminated, cash deposits will be refunded, and the suspension of liquidation will be lifted. If it finds injury, anti-dumping and countervailing duties will be formally imposed. This comes amid a broader pattern of US trade actions targeting agricultural and food-processing imports from Asia, and will be closely watched by India's spice and extract industry.
