Gwalior, March 9 (NationPress) The Madhya Pradesh High Court has ruled that the election of Congress MLA Mukesh Malhotra from the Vijaypur Assembly constituency in Sheopur district is 'null and void'. The judgment was made in response to a petition from Ramniwas Rawat, a senior leader from the Bharatiya Janata Party (BJP) and former Environment Minister in Madhya Pradesh, who had lost to Malhotra in the by-election held in November 2024.
Rawat alleged that Malhotra submitted an inaccurate or incomplete affidavit regarding his criminal history during the nomination phase, breaching the guidelines set by the Election Commission.
During the 2025 hearing, testimonies from administrative officials, including ex-Sheopur Collector Kishore Kumar Kanyal, were presented in court.
After reviewing the evidence, the court deemed the claims credible, asserting that withholding such information infringes upon election regulations.
On Monday, the High Court confirmed that the electoral process was marred by irregularities and the concealment of material details, thus justifying the annulment of the election.
Additionally, the High Court declared that Ramniwas Rawat, who garnered the second-highest votes in the election, will now be recognized as the duly elected MLA for the Vijaypur Assembly constituency.
Malhotra's candidacy for the Vijaypur bypoll was approved at the last moment by the All India Congress Committee, which allowed him to secure a win against BJP's Rawat.
Ramniwas Rawat has a history of success, having won six Assembly elections from Vijaypur on a Congress ticket between 1993 and 2023. He switched to the BJP during the 2024 Lok Sabha elections and was subsequently appointed as the state Environment Minister in Chief Minister Mohan Yadav's Cabinet.
Despite his past victories, Rawat lost to Mukesh Malhotra in the November 2024 bypoll.
