Banerjee subsequently approached the Supreme Court, challenging the order. The apex court permitted him to travel to the US for three weeks in September for medical treatment, while directing that details of his doctor, hospital, accommodation, and flight arrangements — along with his full travel schedule — be provided to the relevant authorities in advance. He is required to return to India within the permitted three-week window.

The US visit has also drawn criticism from the political opposition. Ritabrata Banerjee, Leader of the Opposition in the West Bengal state Assembly, questioned the nature of the trip. According to reports, he said: 'It is being heard that Abhishek is renting a villa in a luxurious place in New Jersey,' and questioned why a villa was required for eye treatment.

The remarks add a political dimension to what Abhishek Banerjee's camp has maintained is purely a medical visit.
