New Delhi, Feb 11 (NationPress) The Central government informed the Supreme Court on Wednesday that Sonam Wangchuk, a prominent social activist from Ladakh, currently detained under the National Security Act (NSA), is considered “fit, hale and hearty” and therefore cannot be released on medical grounds.
During the proceedings, Solicitor General Tushar Mehta represented the Union government, stating before a Bench of Justices Aravind Kumar and Prasanna B. Varale that Wangchuk's health has been assessed periodically, revealing that there is “nothing alarming” that would justify his release.
Mehta opposed any medical-based release, asserting to the Supreme Court: “It will not be possible to release him on health grounds. It may not be desirable, either. We have given utmost consideration.”
He added, “We have examined his health periodically 24 times. He is fit, hale and hearty. He had some digestive issues; he is being treated. There is nothing to worry about, nothing alarming. We cannot make exceptions like this.”
The discussion arose during a habeas corpus petition submitted by Dr. Gitanjali J. Angmo, who challenged her husband's detention as “illegal” and an “arbitrary exercise violating his fundamental rights”.
In a prior hearing, the Supreme Court had urged the Union government to reconsider Wangchuk's ongoing preventive detention, particularly in light of his “not very good” health and advancing age.
The Justice Kumar-led Bench remarked that Wangchuk has been in custody since September 26, 2025, and suggested the government “give it a thought” regarding the necessity of his continued detention.
The Supreme Court had previously warned against further delays in this matter and denied a request for additional time from the government’s legal representative. The court directed that the issue be brought forward for discussion at 2 p.m. on Wednesday, emphasizing to Additional Solicitor General K.M. Nataraj: “You must understand it is a habeas corpus matter.”
